Alice Corp. v. CLS Bank represents the fourth time in the past five years that the Supreme Court has tackled the question of whether a patent was directed to patent-eligible subject matter. This issue has vexed the Patent Office and the courts for decades, and it has an impact on virtually every area of technology – software, life sciences, e-commerce, computer-implemented inventions, etc. In this presentation, our panelists discuss what the Alice decision means, what lessons we can (and cannot) draw from it, and what kind of effect it will have on patent prosecution and patent litigation going forward.
