Patent Litigation
- Novozymes v. Genencor. Represented Novozymes as lead trial counsel asserting patent on genetically modified alpha-amylases. Genencor was found to willfully infringe and ordered to pay double damages and attorneys' fees.
- E.I. du Pont de Nemours & Co. v. Cetus Corporation. Represented Cetus in obtaining a jury verdict upholding the validity of patents for its Nobel Prize-winning polymerase chain reaction and later a consent injunction precluding du Pont's further infringement.
- Elan Pharmaceuticals v Mayo Foundation. Represented Elan to enforce its patent on transgenic mice for the study of Alzheimer's disease. After establishing that the desired transgenic mice could not be made and identified without the essential inventive discovery of the Elan scientists, the patents' validity were upheld on appeal and Elan was able to successfully license them to the principal source of competing transgenic mice, the Mayo Foundation.
- Bausch & Lomb v. CooperVision: Represent CooperVision in a patent infringement case brought by Bausch & Lomb in the Western District of NY relating to contact lenses. Shortly after obtaining a claim construction order highly favorable to CooperVision, the case was settled.
- Schering v. Glenmark. Representing Glenmark, the only challenger to Schering's ezetimibe patent covering $5 billion per year drug. Favorable settlement on the eve of trial followed a Glenmark summary judgment victory.
Securities Litigation
- Ongoing counseling to boards and management on disclosure, regulatory and litigation issues for leading life sciences companies such as Cepheid and DexCom.
- Defense of securities class action and SEC investigation of Connetics alleging inadequate disclosure of FDA communications and pre-clinical tests, improper revenue recognition and insider trading.
- Defense of the directors of drugstore.com (including John Doerr, Melinda Gates and Jeff Bezos) in a derivative action based on allegations of misrepresentations and insider trading. The case is currently pending in Washington state court.
- Defense of shareholder litigation challenging the acquisition of Connetics by Stiefel Laboratories.
- Represented Special Committee of the Affymetrix Board of Directors in federal and state derivative litigation.
