Practice Group Leader:
Fenwick & West LLP's Litigation Group is the right choice for virtually any important business litigation, from
the largest and most complex "bet the company" cases to more typical commercial disputes. Our lawyers have
cutting-edge knowledge and experience in all the important areas of business law, with particular depth in those
areas critical to technology-based businesses. We routinely litigate in the state and federal courts throughout
California, and often throughout the rest of the United States. Our 80 trial lawyers provide the depth to handle
the largest case and provide responsive service in every case. To assure cost-effective and case-winning services,
we support our lawyers with state-of-the-art information technology and highly trained support personnel.
We are ready and able to try those cases that have to be tried, but succeed in resolving many of our clients'
cases prior to trial. Our extensive trial experience allows us to represent our clients forcefully at trial, and
helps us to maximize the effectiveness of our efforts in discovery, motions and other pretrial tasks. Our lawyers
are likewise skilled in post-trial and appellate practice; we frequently brief and argue appeals of cases tried by
other firms. Our deep understanding of the legal policies affecting our clients makes us particularly able to
frame important issues on appeal, and we have been involved in a number of precedent-setting cases. We also have
extensive experience in alternative dispute resolution, bringing the same determination and imagination to settling
cases as we do to trying them. Throughout the litigation process, we stay focused on understanding and achieving
our clients' business goals in the most timely and cost effective manner possible.
Our technology-based clients — including leaders in the Internet, computer hardware and software, semiconductor,
biotechnology and medical device industries — routinely call upon us to handle their most critical intellectual
property disputes. To meet the needs of these clients, we invest heavily to insure we understand the businesses
and technologies behind their products, services and inventions. A number of our litigators have science and
engineering degrees or have worked in technology businesses, and all work closely with Fenwick & West's
patent prosecution lawyers and scientists who provide a unique litigation support capability for technology-based
cases.
We invest extensively in technology and personnel to make our lawyers efficient and effective,
and to make it easier for clients to work closely with us. We communicate with our clients, sharing the documents
and information involved in our cases, via secure extranet sites.
Our
sophisticated in-house technical staff and software tools enable us to handle client documents and data in
electronic form, to maximize the use of computerized search, storage and sorting tools, and to minimize expense.
Members of our in-house technical staff specialize in the use of computer forensic tools and the creation of
graphics for use at hearings and trials, largely freeing us from reliance on less effective, more expensive
independent consultants. Our lawyers use the latest technology to be accessible around the clock. Our WiFi
system provides easy access to our network and the Internet throughout the office.
Many of our lawyers have worked as judicial clerks for judges, gaining invaluable "behind the scenes" experience
about how decisions are actually made and what is (and is not) effective advocacy. Not surprisingly, this
experience is concentrated in California courts, both state and federal. In California, the experience ranges
from the Superior Court to the California Supreme Court in the state system, and from the District Court
(including magistrate and bankruptcy courts) to the Ninth Circuit in the federal system. Outside of California,
our lawyers have clerked on the Tax Court, the Fifth Circuit, the Federal Circuit, and the Supreme Court.
