Guinevere Jobson is a passionate problem solver with a practice focused on commercial and intellectual property litigation and counseling. She handles copyright, trademark, trade secret, right of publicity and other complex commercial and licensing issues for established, emerging and growth-phase technology companies. Her clients include online platforms, digital and social media companies, software providers and hardware manufacturers. Through her deep engagement with in-house teams, executives and engineers, she provides strategic counseling to help clients navigate business risks surrounding new product and feature launches, branding and IP enforcement. She also regularly provides training to in-house teams about emerging legal issues and business risks.

Guinevere has successfully resolved disputes in federal and state court and has substantial experience in commercial and international arbitration proceedings. Working with Fenwick & West’s strategic partner firm Avery & Overy, Guinevere gained extensive experience in IP counseling and litigation matters across Europe, including cross-border litigation and handling numerous copyright, defamation, commercial and patent matters.

Representative Experience:

  • Won summary judgment for granting rights to that name in online social networking and finding the defendant liable for trademark infringement. Ruling included a rare opinion that, as a matter of law, the term “NEXTDOOR” as used for a neighborhood service was merely suggestive, not descriptive. Obtained dismissal with prejudice of all counterclaims, including misappropriation of trade secrets and trademark infringement, brought by owner of “FATDOOR” trademark. Obtained dismissal with prejudice of all claims against for patent infringement.
  • Resolved international arbitration and litigation over terms of software license agreement, and obtained rights through mediated solution.
  • Defended a major internet service provider against claims of secondary liability for copyright infringement in federal jury trial, arguing all evidentiary motions and taking and cross-examining multiple witnesses.
  • Settled complex commercial dispute on favorable terms for a game development studio accused of breach of development and license agreement, transferring all brand and game assets to the client.
  • Defeated class certification for most claims of “click fraud” (i.e., charging advertisers for online clicks that did not genuinely engage with ads), and obtained review by the Ninth Circuit of the remaining portion of an order that partially certified the class, resulting in resolution of the matter for de minimis sum.

Guinevere maintains an active pro bono practice. Among other notable work, Guinevere obtained special immigrant juvenile status for a young man fleeing gang initiation attempts in his home country.

Guinevere is an active member of the Media Law Resources Center and has served on the Association of Business Trial Lawyers Leadership Development Committee.
