Fenwick & West Defends Altera in Trademark Infringement Based on Similar Company Names Claim

Fenwick defended an ex parte application for a temporary restraining order and motion for preliminary injunction over Altera’s claim of trademark infringement against Alterra Healthcare based on similar company names and alleged confusion in the stock markets. After Altera appealed, we then successfully defended the district court’s denial of Altera’s motion for preliminary injunction before the Ninth Circuit. Altera Corporation v. Alternative Living Services, Inc., 1999 U.S. App. LEXIS 27961 (9th Cir. 1999).
