The Regents of University of California v. Micro Therapeutics

Represented The Regents in a suit against Micro Therapeutics (dba ev3 Neurovascular) for willful infringement of a patent portfolio covering the Guglielmi Detachable Coil ("GDC"). The GDC revolutionized the treatment of brain aneurysms in the early 1990's. Dismissed Micro Therapeutics preemptive, declaratory relief action filed in Eastern District of Wisconsin for lack of subject matter jurisdiction and for inconvenient forum. In the later-filed California suit, dismissed antitrust counterclaims alleging fraud in the prosecution of the patents, and also defeated a series of summary judgment motions by defendants asserting unsuccessful non-infringement and invalidity defenses. The matter settled on the eve of trial on terms very favorable to The Regents.
