Compuware v. IBM

After a five-week jury trial, Fenwick & West helped its client Compuware Corporation secure a $400 million settlement against IBM-one of the largest IP Litigation payouts of 2005. Compuware filed various complex intellectual property and antitrust litigation claims against IBM in 2002 for developing software tools that were copied from Compuware's products. The ensuing litigation took place in courts in Michigan and New York and involved claims and counterclaims of copyright infringement, trade secret misappropriation, infringement of over a dozen patents, violation of antitrust laws and related state law claims, all successfully resolved in Compuware's favor under the terms of the settlement.
