Fenwick & West Represents SendMe Mobile in Consumer Class Action

August 06, 2012

Fenwick litigation partner Rodger Cole represented SendMe Mobile in a consumer class action alleging SendMe and Verizon Wireless “crammed” charges on the telephone bills of the purported class. In one of the first district court decisions addressing the issue after the Supreme Court’s decision in Concepcion v. AT&T Mobility, Rodger convinced the trial court to grant a motion to compel arbitration and stay the proceedings pending the arbitration. The case was subsequently resolved on an individual basis while the plaintiff’s appeal was pending before the Third Circuit.
