Fenwick Successfully Defends Symantec in Statutory Unfair Competition Class Action

Fenwick defended Symantec in California state court in a consumer class action for statutory unfair competition (California Business & Professions Code Section 17200, et seq.) and false advertising (California Business & Professions Code Section 17500, et seq.) related to its WinFaxPRO software. After limited discovery, the matter settled on a non-class basis with no payment to the purported class. After settlement, the team defeated plaintiffs’ motion for attorneys’ fees, and plaintiffs’ counsel received no fees.
