Fenwick & West Defeats Preliminary Injunction to Pave Way for Lexar Merger with Micron

Fenwick & West's Securities Litigation Group successfully defeated a preliminary injunction motion brought by shareholders of Lexar Media, Inc. (Nasdaq: LEXR), attempting to enjoin a vote on the proposed merger with Micron Technologies (NYSE: MU).

Fenwick & West is representing Lexar in the merger, which was announced on March 8, 2006. A group of shareholders filed suit in Alameda County Superior Court, and thereafter sought to enjoin the merger. The court's May 31, 2006, denial of the preliminary injunction motion allows Lexar's special meeting of stockholders to proceed.
