PSKS, et al. v. Leegin Creative Leather Products

May 01, 2009

Defended major leather accessories and jewelry manufacturer against claims of vertical price fixing brought by two former retailers. The initial trial, which involved allegedly per se illegal vertical price agreements, resulted in an adverse verdict for our client Leegin, but we prevailed in appeals all the way to the U.S. Supreme Court, which overruled a 96 year old precedent and held that such agreements should be evaluated under the Rule of Reason in which all competitive effects are considered.
