Lashify Victory, Saina Shamilov Featured in Law360's ‘Top Patent Decisions Of 2025’

A groundbreaking Federal Circuit victory on behalf of client Lashify that expands small business access to the U.S. International Trade Court was featured in Law360’s top patent decisions of 2025.

The article unpacks a number of other key patent decisions and features insights from Lashify co-lead counsel Saina Shamilov.

In Lashify, the ITC originally denied the eyelash extension maker, which was founded in a U.S. living room and has grown to employ 100 people in the states, because the ITC didn’t count costs like sales, marketing, and warehousing when determining whether a company can establish domestic industry.

"That's not a logical conclusion of what the ITC is designed to do, which is [to] protect domestic businesses,” Shamilov told Law360.

This year, Shamilov’s team convinced the Federal Circuit as much, with Law360 predicting in March that the outcome would lead to a “pronounced shift that will likely spur considerably more ITC cases.”

Indeed, Law360’s top patent decisions article quoted an unrelated attorney who explained that “there's already been a real-world impact from Lashify” in at least one case he’s worked on.

Speaking about other significant cases, Shamilov offered her perspective on how the EcoFactor v. Google Federal Circuit decision creates a tool for stronger damage-model scrutiny, as well as a nuanced view on the compatibility between Recentive Analytics v. Fox and Ex Parte Desjardins.
