Fenwick Named Finalist for Tech Litigation Department of the Year

Fenwick has been named one of the finalists for Tech Litigation Department of the Year in The Recorder’s California Leaders in Tech Law and Innovation Awards.

The awards celebrate the achievements of lawyers and companies leading technology, innovation and the profession as a whole.

The Recorder noted that Fenwick’s litigation team has helped defeat patent challenges, securities litigation suits, and class actions and shareholder derivative lawsuits on behalf of tech clients including Amazon, Uber, Tesla and Cray.

  • Led by partners David Hadden and Saina Shamilov, Fenwick represented more than 60 customers of Amazon Web Services in an effort to shut down a patent litigation campaign by nonpracticing entity PersonalWeb Technologies, successfully staying the suits against the customers and winning summary judgment, eliminating some of PersonalWeb’s claims. The firm also represented Amazon when the U.S. Court of Appeals for the Federal Circuit upheld the team’s win at the district court finding the asserted patents invalid under the U.S. Supreme Court’s Alice v. CLS Bank standard or non-infringed in Innovation Sciences LLC v. Amazon.com Inc.
  • Fenwick obtained dismissal of a high-profile derivative action in the Delaware Court of Chancery against Uber’s Board of Directors in connection with Uber’s acquisition of Ottomotto.
  • Led by partners Dean Kristy and Jennifer Bretan, Fenwick obtained dismissal with prejudice of an stockholder class action accusing Tesla of misleading investors about production of its new Model 3. In dismissing the case, the court found that Tesla had been forthright in disclosing the challenges of producing Model 3, its first mass market vehicle, and had made no false statements.
  • Led by partners David Tellekson, Bryan Kohm and Melanie Mayer, Fenwick obtained summary judgment for supercomputer maker Cray from the U.S. District Court for the Western District of Wisconsin on two supercomputer patents that had been asserted by Raytheon in Raytheon Company v. Cray.
