January 19, 2011 (Mountain View, CA) – Fenwick & West is pleased to announce that Robert Brownstone has been appointed Technology & eDiscovery Counsel and Co-Chair of the firm's EIM Group. Mr. Brownstone's appointment reflects the continued expansion of the EIM Group's size and capabilities as EIM-related risk rises in prominence for Fenwick’s clients.
"EIM-related obligations in litigation, investigations and corporate transactions continue to expand rapidly as courts and legislatures try to keep up with the pace of technology innovations. Our clients are being more proactive about implementing enterprise-wide changes to mitigate exposure in these areas." stated Mr. Brownstone. "Fenwick meets those needs by combining 'Law and IT in one brain.'"
In addition to the eDiscovery, Privacy and Information-Security related services that Fenwick has offered to its clients for over a decade, the firm's EIM capabilities now include a variety of hybrid law-and-IT services, including:
- eDiscovery Project Management
- IT Consulting to best implement Records Retention/Destruction and Production Responsiveness
- Enterprise-wide (Legal, IT, HR, R&D, Corporate, Tax, Audit) development of Records-Retention/Litigation-Preparedness policies and internal controls processes to enable corporate governance and regulatory compliance
- Information-Security Audits
- Data-Breach Incident-Response
- Extremely cost-effective data hosting platforms for litigation and corporate transactions
In turn, these efforts help improve Fenwick's efficiency and economy, including with management of alternative fee arrangements (AFAs). Partner Patrick Premo, the firm’s AFA Program Leader for litigation matters, noted that, "my internal AFA team, and therefore the firm's clients, will benefit from Bob Brownstone's greater involvement in helping our litigators and Practice Support technology group to provide cost-effective, efficient services."
Mr. Brownstone is a nationally-recognized advisor, author and thought leader on law and technology. He speaks regularly across the country to attorneys, IT leaders, HR professionals and other corporate executives about EIM, privacy and eDiscovery issues. Mr. Brownstone also teaches Electronic Discovery Law & Process as an adjunct professor at the University of San Francisco School of Law and Santa Clara University School of Law.
