Fenwick & West Partner Rodger Cole Honored as one of Daily Journal’s Top 20 Under 40

January 23, 2009 (Mountain View, CA)—Rodger Cole, a litigation partner and Co-Chair, IP & Technology Litigation Group with Fenwick & West LLP, was selected as one of the top 20 lawyers under the age of 40 in the Daily Journal's annual list.

2008 was a busy year for Rodger with three significant litigation wins:

  • A Hollywood-made trademark and copyright infringement victory defending client Capcom against claims that their video-game, "Dead Rising," infringed on the IP rights of MKR, owners of the zombie movie "Dawn of the Dead;"
  • A summary judgment victory for client Virgin Mobile, who was sued by BrandPort for misappropriation of 55 trade secrets; and
  • A significant development in the law governing online contracts for client Intuit by prevailing on a motion to dismiss that enforced the disclaimer of implied warranties in clickwrap end user license agreement – the first reported decision of that nature.

The Daily Journal also praised Rodger for his humor, sociability, devotion to family and commitment to mentoring.
