New ITC Rules Will Trim Discovery, Attorneys Say

​Litigation attorney Bryan Kohm was quoted in a Daily Journal article titled “New ITC Rules Will Trim Discovery, Attorneys Say.” The article reports that new rules issued by the International Trade Commission will remove a number of the burdens associated with discovery requests and will be much closer to those in the federal courts. 

Kohm said in the past, parties wanted to file at the ITC rather than the federal courts to take advantage of the broad discovery rules. The proposed rules specifically allow administrative law judges at the ITC to limit discovery requests that seek information that is duplicative, overly burdensome or marginally important. It also lays out detailed procedures for discovery of privileged information.
