Supreme Court IP Recap: Copyrights & Trademarks

Fenwick trademark litigation partner Eric Ball talked to Law360 about key trademark and copyright cases to be considered by the U.S. Supreme Court in the next term.

This past term, two trademark decisions, Mission Product Holdings Inc. v. Tempnology LLC and Iancu v. Brunetti, continued the high court interest in remodeling little-known aspects of trademark law.

Ball hopes for a reversal of this trend during the next term.

“In trademark cases over the last few years, the justices changed a few light fixtures by addressing obscure or infrequent issues. Now, it’s time for the Supreme Court to start knocking down walls and addressing some of the bigger issues,” Ball told Law360.
