Michael Sacksteder, chair of Fenwick’s patent litigation group, discusses the Innovation Act in the Daily Journal article “House of Representatives approves Silicon Valley-backed patent bill.”
Two years after Congress passed the America Invents Act, the House passed its package of patent litigation reforms, the Innovation Act on December 6. Sacksteder tells the Daily Journal that the reforms are “generally helpful” for lawyers defending companies against patent trolls. He’s paraphrased as adding that “the bill’s controversial fee shifting provisions potentially raises the stakes in many patent infringement complaints, including in lawsuits that do not involve patent holding companies.”
"Legislation like this is by its nature a blunt instrument," Sacksteder said. "It's swinging toward its intended target, but it may hit others as well."
