Fenwick & West patent partner Stuart Meyer spoke with Law360 after Senator Patrick Leahy pulled from the Senate Judiciary Committee’s agenda his bill designed to combat patent trolls.
Meyer noted that historically Congress has not quickly passed intellectual property legislation and that bills similar to the America Invents Act failed in Congress for years before it was finally passed.
As paraphrased by Law360, he said, “It often isn't until measures are proposed and debated that unintended consequences of IP bills become apparent, and ‘that's exactly what seemed to have happened here.’”
"It's a shame to have to wait,” Meyer added, “but it's better to get good legislation, even if it comes a little later.”
