Fenwick & West LLP ("Fenwick & West," "we," "us") provides this Privacy Policy to inform users of our policies and procedures regarding the collection, use and disclosure of information received from users of this website located at www.fenwick.com ("Site"). Please note that this Privacy Policy only applies to this Site and does not apply to any third-party websites, services or applications, even if they are accessible through our Site. This Privacy Policy may be updated from time to time for any reason. We will notify you of any material changes to our Privacy Policy by posting the new Privacy Policy on our Site and updating the “Last Updated” date. You are advised to consult this Privacy Policy regularly for any changes.

Information Collection and Use

Our primary goals in collecting information are to provide and improve our Site, to administer your use of the Site, and to provide you with information that you request from us via your use of the Site, including, without limitation, the provision of information about Fenwick & West hosted events and the Fenwick & West Alumni Group, the delivery of our email "legal updates" to subscription groups and responding to queries about, or applications for, job listings.

Personally Identifiable Information. Personally Identifiable Information is information that can be used to identify you, such as your name, email address, postal address and phone number (“PII”).  In general, it is not necessary to provide us with PII in order to use the Site. There are certain services we offer, however, which require creation of an “Account” (e.g., to join the Fenwick & West Alumni Group; one of our "legal updates" subscription groups; or to obtain Client Login access). If you create an Account, we’ll collect your name and email address, and other information you may voluntarily supply such as your title, company, phone number and postal addressIf you contact us by email through the Site, we may keep a record of your contact information and correspondence, and may use your email address, and any information that you provide to us in your message, to respond to you.  We also use your PII to send you publications, legal alerts and updates, surveys and invitations to seminars, conferences and other events that may be of interest to you. In addition, we may send you important administrative information regarding the Site and/or services we offer via the Site. If you decide at any time that you no longer wish to receive communications from us, please follow the unsubscribe or opt-out instructions provided in any of the communications or update your "user preferences" information.

Log Data. When you visit the Site, our servers automatically record information that your browser sends whenever you visit a website ("Log Data"). Log Data may include information such as your Internet Protocol (IP) address, browser type, operating system, the web page that you were visiting before accessing the Site, the pages or features of the Site which you browsed and the time spent on those pages or features, search terms, the links on our Site that you clicked on and other statistics. We use Log Data to monitor use of the Site and the services we offer via the Site and for the Site’s technical administration.

Cookies

Like many websites, we also use "Cookie" technology to collect certain information.  Cookies are small text files that are placed on your device by a Web server when you access our Site. We may use both session Cookies and persistent Cookies to identify that you’ve logged in to the Site and to tell us how and when you interact with the Site and the services we offer via the Site. We may also use Cookies to monitor aggregate usage and web traffic routing on the Site, and to customize and improve the Site and services we offer via the Site. Note that this Privacy Policy covers only our use of Cookies and does not include use of Cookies by such third parties.

Information Sharing and Disclosure

Alumni Group. If you are a Fenwick & West alumnus, you can create an Account to join the Fenwick & West Alumni Group.  When you create an Account, your profile ("Alumni Profile") will be added to our alumni directory. The alumni directory is available to other Fenwick & West Alumni who also have accounts. You can choose the information about yourself that you wish to make visible to other members by making selections at the Fenwick & West Alumni Group "Update" Alumni Profile webpage, including electing not to have any information listed in the directory.

Service Providers. Fenwick & West may employ third party companies and individuals to facilitate the provision of services via the Site, or to perform certain Site-related services (e.g. hosting and maintenance services, database management and improvement of the Site’s features). We may from time to time share your PII with such third parties to administer or complete these tasks. These third parties only have access to your information as necessary to perform their functions and may not use it for any other purpose.

Third Parties.  We may share aggregated information and non-identifying information with third parties for industry research and analysis, demographic profiling and other similar purposes.

Compliance with Laws and Law Enforcement. Fenwick & West cooperates with government and law enforcement officials or private parties, to enforce and comply with the law. We may disclose any information about you, including PII, to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims, legal process (including subpoenas), to protect the property and rights of Fenwick & West or a third party, the safety of the public or any person, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with the law.

Business Transfers. If any or all of the assets of Fenwick & West are acquired by, or merged with, another entity we will share some or all of your information with this entity.

Changing or Deleting Information

You can access and modify the PII associated with your Account by emailing website@fenwick.com. If you want us to delete your PII and your Account, please contact us at website@fenwick.com with your request. We’ll take steps to delete your information as soon we can, but some information may remain in archived/backup copies for our records or as otherwise required by law.

Responding to Do Not Track Signals

Our Site does not have the capability to respond to “Do Not Track” signals received from various web browsers.

Security

Fenwick & West is very concerned about safeguarding the confidentiality of information that we collect about you (including your PII). We take reasonable administrative, physical and electronic measures designed to protect your information from unauthorized access, use or disclosure.  Please be aware, however, that no method of transmitting information over the Internet or storing information is completely secure. Accordingly, we cannot guarantee the absolute security of any information.

International Transfer

Your PII may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction.  If you’re located outside the United States and choose to provide your PII to us, we may transfer your PII to the United States and process it there.

Links to Other Sites

Our Site contains links to other websites including those of our clients. If you choose to visit an advertiser by "clicking on" a banner ad or other type of advertisement, you will be directed to that third party’s website. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit personal information from you. This Privacy Policy addresses the use and disclosure of information that we collect from you through this Site. Other sites follow different rules regarding the use or disclosure of the personal information you submit to them. We encourage you to read the privacy policies or statements of the other websites you visit.

Our Policy Towards Children

This Site is not directed to children under 18. If a parent or guardian becomes aware that his or her child has provided us with PII without their consent, he or she should contact us at website@fenwick.com. If we become aware that a child under 13 has provided us with PII, we will remove such information from our files.
