The Supreme Court's decision in Alice Corp v. CLS Bank has resulted in a swath of patent invalidations in the federal courts for lack of patent eligible subject matter under 35 USC 101, and a similar unprecedented wave of rejections of pending patent applications. This talk will survey the current landscape of Section 101 cases, the USPTO's Interim Guidance on Subject Matter Eligibility, and potential legislative proposals to address the impact of Alice.
