Developments in Secondary Copyright Liability

We have come a long way since the Grokster and YouTube decisions started transforming the landscape of secondary copyright liability doctrine. In recent years, there have been further refinements to the DMCA, including the Copyright Office’s study of § 512 and new lawsuits commenced against Amazon and Vimeo for their alleged roles in fostering copyright infringement. Most recently, the district court decision in BMG v. Cox could affect ISPs’ processes for handling copyright complaints, and the EU Court of Justice’s decision on hyperlinking in GS Media v. Sanoma may have a profound impact on the global enforcement of copyrights on the Web. This program will survey recent developments in secondary copyright law and bring everyone up-to-date on this evolving area.​​​
