Stuart—an electrical engineer turned patent lawyer—uses his technical background to provide strategic intellectual property counseling to clients, ranging from small startups to multinational public companies, throughout the lifecycle of their businesses. He also represents other prominent organizations in the technology space, such as the Massachusetts Institute of Technology, for which he served as counsel in litigation involving the so-called RSA encryption patent, considered to be fundamental to data privacy.

Stuart co-chairs Fenwick’s post-grant proceedings practice and is consistently recognized by Chambers USA as a top IP advocate. He handles a wide range of IP-related matters, including:

  • Performing strategic IP planning and audits
  • Securing patent, copyright and other IP rights
  • Helping clients establish trade secrets and other IP policies
  • Managing patent reexaminations and other post-grant matters
  • Representing companies in technology-based litigation
  • Managing risk for clients who use or provide AI systems

Stuart manages the firm’s innovative, client-forward Vermont operations facility.

Stuart also maintains an active pro bono practice, focusing on increasing diversity in the IP field. He represented Fenwick as a founding member of the group that created the California Inventors Assistance Program (CIAP), a pro bono program in cooperation with the U.S. Patent and Trademark Office and California Lawyers for the Arts. He currently serves on the organization’s advisory board.

  • Stuart is a chapter author in Overlapping Intellectual Property Rights, (second edition) published by Oxford University Press in 2023
  • Stuart co-founded the firm’s popular Bilski Blog, a patent law and developments forum, where he retains a chief editing role and is an active contributor.
  • Stuart serves as lead editor of the firm’s Intellectual Property Bulletin.
  • With his deep understanding of artificial intelligence, Stuart co-authored the book, “Responsible AI: A Global Policy Framework,” published by ITechLaw (2019)—the book was a year-long collaboration between Stuart and a multi-disciplinary team of technology law professionals, researchers and industry representatives from 16 countries.
  • Stuart has been a guest lecturer on copyright law at the University of California’s Berkeley School of Law. He has contributed to books, authored numerous articles on IP law and is frequently invited to lecture throughout the U.S. and abroad.
  • Stuart has written widely on the America Invents Act as well as the PTO’s final rules implementing the AIA.
