The Federal Circuit ruled in favor of our clients, The Regents of the University of California and Abbott, its licensees, Abbott Molecular and Abbott Laboratories, in vacating a summary judgment of non-infringement under the doctrine of equivalents. This is only one of three cases in the Federal Circuit to successfully assert the "tangential relationship" exception to Festo. This case involves methods for identifying and classifying chromosomes using fluorescent in situ hybridization techniques.
