About Our India Practice

Fenwick’s India Practice counsels clients in the U.S. and India on cross-border legal issues that arise in a variety of contexts. Known for our extensive transactional and dispute experience and familiarity with the technology sectors and laws in both countries, clients in the U.S. and India rely on us for advice on a wide range of corporate, intellectual property, litigation, labor and employment, dispute resolution and cross-border tax-related matters, including cross-border financings, mergers and acquisitions, joint ventures, corporate restructurings and employment mobility issues.

The firm's corporate and intellectual property lawyers represent clients on complex cross-border transactions in industries such as software and information technology (including eCommerce, mobile, Internet, electronics and security), life sciences (including pharmaceuticals), and clean technology (including renewable energy). Through our corporate and tax practices, we help companies form and structure corporate entities to efficiently operate in the U.S., India and elsewhere. Our litigators handle complex litigation disputes involving intellectual property, securities, tax and employment issues.

We represent a wide range of cross-border entities, from emerging companies to large, established multinationals. Representative India-based clients include Reliance Industries, TaTa, InMobi, SMS GupShup and Druva Software, and representative U.S.-based companies with significant operations in India include Cisco Systems, Symantec and Synopsys. We also advise venture capital funds such as Kleiner Perkins Caufield & Byers and Sherpalo Ventures in their investments and other transactions in India.

As with any market, having the right local relationships is imperative to successfully representing our clients. In India, we have close working relationships with leading law firms, government and accounting/tax experts. This is exemplified by our attorneys that have been on the ground in India. For example, at the invitation of the High Courts of India, Fenwick partner Vic Schachter has been participating in projects to establish and develop mediation centers in New Delhi, Bangalore, Kochi, Chennai and elsewhere to reduce the backlog of court cases and facilitate timely, fair dispute resolution. In another example, Fenwick partner Rajiv Patel co-chaired one of the largest legal conferences in India for the global International Technology Law Association for a number of years.
