Fenwick & West was founded in 1972 in the heart of Silicon Valley—before “Silicon Valley” existed—by four visionary lawyers who left a top-tier New York law firm to pursue their shared belief that technology would revolutionize the business world and to pioneer the legal work for those technological innovations. In order to be most effective, they decided they needed to move to a location close to primary research and technology development. These four attorneys opened their first office in downtown Palo Alto, and Fenwick became one of the first technology law firms in the world.

Our more than 25 licensing and technology transactions professionals are devoted full-time to negotiating commercial agreements. We have negotiated hundreds of licenses and agreements on behalf of our clients with many of the world’s leaders in the communication industry, such as AT&T, Sprint, Orange, T-Mobile, Nokia, 20th Century Fox, Orange and O2 UK. Our experience includes licensing agreements, master development and support agreements, negotiation of distribution agreements, reseller agreements, strategic OEM agreements, wireless service resale and sales representative agreements, and the formation of joint ventures.
We have extensive federal and state litigation experience at both trial and appellate levels brought by the DOJ and the FTC, including civil and criminal government investigations, mergers, distribution programs, price-fixing, monopolization, and Robinson-Patman price discrimination claims. In addition, our antitrust attorneys have handled over 150 filings with the FTC and DOJ antitrust sections specifically responsible for high technology matters, including many of the most significant transactions in the communications industry, such as Cisco System’s $6.9billion acquisition of Scientific-Atlanta.
