Two Trial Victories in Three Weeks? No Problem for Fenwick’s Patent Litigation Group

Mountain View, CA (April 3, 2014) - Spring is off to a great start for patent litigators at Fenwick & West LLP. Fenwick trial teams brought home two winning patent jury verdicts for their clients in one 20-day span in March and early April.

First, on March 12, a team led by Fenwick patent litigators David Hadden, Saina Shamilov, and Ryan Tyz scored a defense trial victory for clients Zillow and Adchemy in a patent infringement lawsuit brought by competitor LendingTree. After a five-week trial that started on February 10, the Charlotte, North Carolina jury returned a verdict finding that neither of the asserted patents was infringed, and that the two asserted patents were invalid because they named the wrong inventors.

Then, on April 1, a team led by Fenwick’s Michael Sacksteder and Bryan Kohm won a jury verdict in another case between competitors in the United States District Court for the District of Delaware. In that trial, the jury found that two patents owned by Fenwick client Silver Peak Systems were infringed by competitor Riverbed Technology and rejected Riverbed’s invalidity challenge to one of the Silver Peak patents. That litigation had been initiated by Riverbed, but the claims on Riverbed’s patents were stayed by the court after the asserted claims of two of them were found invalid in inter partes reexaminations before the Patent and Trademark Office.
