Prediction markets allow users to bet on just about anything; including geopolitical events. In a recent interview with American Banker, Noah Solowiejczyk, a partner in Fenwick's white-collar and investigations practice, explored the national security implications of trading on confidential government information and military secrets, as well as how such conduct may already be prohibited under existing laws.
Solowiejczyk also discussed the Commodity Futures Trading Commission’s role in regulating these markets, and predicted that, while insider trading enforcement in this area is nascent, it’s coming. "They just need the right test case," he said.
