For more than 25 years, Tyler has advised and represented innovative businesses in litigation when technological change confronts legal uncertainty. Technology clients regularly turn to Tyler to represent them in disputes and regulatory investigations involving complex privacy, data access and use, copyright, right of publicity, trade secret and advertising issues. Tyler is a first chair trial lawyer who has tried copyright, trademark, trade secret, computer hacking, breach of contract, and fraud cases before juries, judges and arbitral bodies. As a former federal prosecutor, Tyler approaches each case from the outset with an eye toward preparing it for trial. Much of Tyler’s practice is defending class actions, and he has defeated and negotiated favorable class action settlements of privacy, data security, and consumer protection class actions involving tens of millions of consumers.
Tyler leverages his litigation experience to serve as a trusted counselor to businesses large and small on reducing their litigation risk on privacy, data use, and secondary liability issues. Tyler frequently counsels companies on compliance issues relating to key federal regulations such as the Computer Fraud and Abuse Act (CFAA), Electronic Communications Privacy Act (ECPA), Children’s Online Privacy Protection Act (COPPA), General Data Protection Regulation (GDPR), the Telephone Consumer Protection Act (TCPA), the Fair Credit Reporting Act (FCRA), and state privacy laws, including the California Consumer Privacy Act (CCPA).
There are increasingly complex state laws and foreign statutes, and even small startups have global footprints now. We’re trying to anticipate what our clients’ needs will be in the coming years.”
