Landslide: Brand Enforcement in the World of GDPR: Lessons Learned and Best Practices for IP Practitioners

Join this panel of IP practitioners, including Fenwick's Mark Jansen, as they outline the General Data Protection Regulation ("GDPR") and its provisions, and provide best practices for IP owners to employ in the post-GDPR world.

The European Union transformed the global landscape of data protection and privacy when it passed the GDPR, which entered into force on May 25, 2018. Among those impacted by its provisions are brand owners. GDPR provisions have led to a substantial reduction in the amount of public information about who owns and operates any given website through the online domain name. Brand owners have traditionally relied on this public information for enforcement, presenting huge challenges to online enforcement efforts.

This program will provide an overview on the GDPR and the challenges in online intellectual property enforcement caused by its provisions. The panel will discuss observations and lessons learned since the GDPR took effect, significantly reducing the amount of registration information available for IP enforcement. The program will also include a discussion of best practices and strategies for intellectual property owners to employ as part of their online enforcement programs in the post-GDPR world.​
