The America Invents Act (AIA) introduced several new proceedings to contest the validity of patents at the U.S. Patent and Trademark Office (USPTO), including inter partes reviews (IPRs), post-grant reviews (PGRs), covered business method reviews (CBMs) and derivation proceedings. Overseen by the Patent Trial and Appeal Board (PTAB), these new procedures, along with traditional ex parte reexaminations, provide mechanisms to decide (in)validity disputes without the complexity and cost of full-scale district court litigation.
The law behind these contested proceedings is evolving rapidly, and it is with this ever-changing landscape in mind that Fenwick & West created its interactive Patent Trial and Appeal Board Decision Search Tool. Designed to help our clients build awareness around the latest developments in the post-grant space, the tool provides an easy and interactive user interface for users to examine key takeaways provided by recent decisions at the PTAB in several core areas.
Recent PTAB decisions are represented by the dots below, with each dot sorted chronologically by decision date and color coded by issue category. Scroll over each dot to view details about the proceeding, including the case name, key takeaway from the decision and date. Click on the name at the top of the detail box to access the full text of the proceeding. Filter the decisions displayed by entering a keyword in the Filter by Keywords field or by sliding the boxes on the date range slide bar.
