The Data Security and Data Breach Litigation Landscape: Recent Developments in Data Breach Litigation

This program will review recent developments in how Courts are handling litigation arising out of data security breaches both big and small. Recent rulings on motions to dismiss putative class actions arising out of data breaches appear to lower the bar for plaintiffs to get past the pleading stage. This program will review existing SEC regulatory enforcement actions and the growing trend of derivative and class actions arising out of high-profile data breaches. The program will also gaze into the crystal ball at what further regulatory guidelines, rulemaking and legislation may be on the horizon.
