Heidi Lawson Unpacks 2026 Insurance-Industry AI Changes with Law360
Coverage for AI-related risks remains fragmented across the insurance market, with no single policy addressing a company's full exposure, but 2026 could see major movement on that front, Fenwick insurtech industry lead Heidi Lawson told Law360 in a feature on how AI is reshaping the insurance industry in 2026.
"There isn't an AI silver bullet insurance coverage that solves the issues for a company across the board," Lawson told the outlet. "Trying to literally stitch together solutions to help protect against that risk and to understand what the outer limits are of what is covered and isn't covered is a big challenge."
While affirmative AI coverage has so far come mainly from standalone policies offered by specialized and startup insurance participants, Lawson said established carriers are likely developing endorsements that would bring affirmative AI coverage into technology errors and omissions policies.
"I think what we will see is the larger insurers starting to affirmatively cover it by endorsement, potentially trying to see if they can get what they call add-on premium opportunity," she said.
