How are U.S. insurers adapting coverage to meet the AI moment? Fenwick insurtech counsel Mallory Goodwin spoke with Law360 about how carriers in the U.S. and beyond are delineating coverage for losses "arising out of" generative AI.
While the U.S. insurance market has largely addressed AI risks with new exclusionary language, carriers in the United Kingdom are now more frequently extending "affirmative" AI coverage.
Affirmative coverage, however, shifts uncertainty, rather than eliminating it, Goodwin told Law360.
"It simply shifts the conversation from whether there is AI coverage to what AI coverage actually exists under the specific policy and what limitations it may have," she said. "Ultimately, the specific language will still drive the outcome and requires policyholders to carefully evaluate whether the language addresses their individual AI risk."
