Litigation Associate Jennifer Bush’s Take on USPTO Director Featured in IP Strategist

In an article featured by The Intellectual Property Strategist, litigation associate Jennifer Bush unpacks the major changes that U.S. Patent and Trademark Office Director Kathi Vidal has brought over the course of her year-and-a-half tenure. As Jennifer writes, Vidal ratcheted up director reviews, issued several new pieces of guidance, designated additional cases as precedential, issued sanctions unprompted, and returned institution rates to 2016 levels—and she won’t likely end there.

“Practitioners should expect additional adjustments to PTAB practice under Director Vidal, who is making affirmative efforts to address parties’ concerns and to streamline and improve PTAB processes,” she wrote. “The changes to date may only be the tip of the iceberg.”
