Lashify’s groundbreaking $30.5 million patent-infringement win continues to reverberate across the fashion and legal industries—now with a spotlight by The Fashion Law.
A jury found last month that Chinese copycat Qingdao Lashbeauty Cosmetic Co. willfully infringed three of Lashify’s revolutionary DIY eyelash patents, awarding Lashify $30.5 million in lost profits and setting a 30% royalty rate.
That willfulness finding could lead to treble damages and increased liability for Qingdao Lashbeauty, The Fashion Law noted.
Patent protection is rare in the beauty industry, which is rife with copycat products as a result, but the outcome could change that, as Lashify’s victory demonstrates that enforcement is a viable path for protecting innovations in this space.
The Fashion Law noted that the dispute centered on several patents in Lashify’s larger portfolio that cover various aspects of Lashify’s lash extension system, including the structural design of the lashes, the method of application, and the unique adhesive and tools used to apply them.
