Saina is a trial lawyer and a top-ranked practitioner representing the world’s leading technology companies in high-stakes commercial and intellectual property litigation disputes. She co-leads the firm’s patent litigation group. With over 20 years of experience in all aspects of pre-trial, trial and appellate practice, she has been recognized by peers and clients as one of the best to help resolve litigation disputes in the least painful but most favorable way for her clients. She wins her cases early and, when needed, takes them through winning trials. Patexia has repeatedly recognized Saina among the top 10 best performing patent litigators in the country, The Daily Journal honored her among the Top Women Lawyers, and the PTAB Bar Association has consecutively named her to its Top 50 Women in PTAB Trials list. Saina has successfully represented clients in various technological fields, including AI, cloud computing, machine learning, natural language processing, gaming, networking and telecommunications, e-commerce and internet-related technologies, CRM systems and database management, as well as in the beauty and fashion fields. She has represented clients in various jurisdictions around the country, including the Northern District of California, Eastern District of Virginia, District of Delaware, Western District of Texas and Eastern District of Texas. She has obtained winning jury verdicts in venues such as District of Delaware, Eastern District of Texas and Western District of Texas. She has also represented clients in Section 337 investigations instituted by the U.S. International Trade Commission and in front of the Patent Trial and Appeal Board.

What sets Saina apart from her peers is her time spent as a software engineer prior to attending law school. Her technical background allows her to effectively understand her clients’ technologies and translate difficult technical issues into arguments that are understandable and compelling to the judge or jury. She has secured winning jury verdicts, obtained dismissals of numerous cases on early motions with minimal incurred costs, successfully transferred disputes against her clients to more convenient and favorable jurisdictions and secured winning appellate decisions in complex high-stakes litigation disputes for the world’s most recognized companies.

Saina maintains an active pro bono practice and has been recognized by the Bar Association of San Francisco’s Justice & Diversity Center as an Outstanding Volunteer for her pro bono work. She also co-chairs Fenwick's patent litigation group, co-leads Fenwick’s Women Caucus, and is a member of several other leadership committees at the firm.   • A summary judgment in declaratory judgment action against PersonalWeb Technologies on behalf of Amazon and 80+ AWS customers, including Airbnb, Kickstarter, GoPro and Venmo; Federal Circuit affirmed in a precedential opinion that enlarged Kessler preclusion to the benefit of all patent infringement defendants; subsequently won summary judgment of non‑infringement on PersonalWeb’s remaining claims followed by $4.8 million in attorney fees and nontaxable costs for Amazon.
  • A full defense verdict for Amazon in a patent dispute in the Western District of Texas against competitor Freshub, which was seeking $246 million in damages; a jury found that Amazon’s Alexa-powered smart home devices did not infringe patents held by Freshub.
  • A full defense verdict for Amazon in the Eastern District of Texas against Virginia Innovation Sciences (VIS); the jury found no infringement of any asserted claims and concluded that the patents were invalid.
  • Successfully represented Amazon in a suit brought by VIS, in the Eastern District of Virginia, which asserted 11 different patents against an array of Amazon products and services. We secured a ruling that eight of the patents were ineligible under § 101, which was affirmed by the Federal Circuit. We then secured claim constructions that made it impossible for VIS to establish infringement on the three remaining patents and won summary judgment on all claims that VIS pursued thereafter. The district court awarded Amazon its attorney fees, which was affirmed by the Federal Circuit.
  • On behalf of Amazon, successfully got three patents directed to a natural language processing technology service—owned by IPA Technologies—invalidated on the pleadings under § 101 because they were directed to ineligible subject matter and claimed only abstract ideas, and later in the case secured a summary judgment of non-infringement on the remaining patents.
  • Obtained findings of infringement on behalf of a beauty technology company Lashify in front of the International Trade Commission in a Section 337 Investigation.
  • Obtained a summary judgment of invalidity of all asserted patents on the eve of trial in the Western District of Texas.
