Amazon Gets 8 Video Patents Killed Under Alice

Law360 reported that Amazon obtained a recent victory in a patent infringement suit brought by Virginia Innovation Sciences Inc. in the Eastern District of Virginia. Amazon argued that eight out of 10 asserted patents were invalid under 35 U.S.C. 101 and the U.S. Supreme Court's decision in Alice Corp. Pty. Ltd. v. CLS Bank International and its progeny.

On January 5, 2017, the Virginia federal judge presiding over the case, Liam O’Grady, agreed and invalidated the eight challenged patents “marking an unusually high number of patents found ineligible under the Alice standard in one fell swoop,” Law360 noted.

Amazon is represented by a Fenwick team led by patent litigation partners David Hadden and Saina Shamilov.
