Devin’s practice focuses on high-tech patent and trade secrets litigation before district courts and the Patent Trial and Appeal Board. Devin combines his litigation experience with his technical background in mechanical engineering and patent prosecution experience to advise technology companies on IP disputes across a broad range of industries, including the telecommunications, networking, computer hardware, payments, oil and gas, and medical device industries.

Devin has substantial experience managing all phases of patent litigation, from pre-suit investigation, motion practice, claim construction, and discovery through trial. Devin is particularly adept at working with technical and damages experts to develop strategies at the core of his clients’ cases across venues nationwide.

Prior to joining Fenwick, Devin was an associate at an international law firm and at a boutique intellectual property firm. He was also a judicial intern for two federal judges in the District of New Jersey.

  • Represented an oilfield services company in the trial of a patent infringement litigation filed by its competitor, which alleged infringement of patents involving hydraulic fracturing software and methods of operating electric fracturing equipment. Secured near-complete jury verdict with a finding of non-infringement of all three patents and invalidating two of the three.
  • Won summary judgment on behalf of a healthcare company by invalidating asserted patents related to infant probiotics in patent, unfair competition, and false advertising litigation in the Northern District of Illinois.
  • Obtained favorable settlement after leading mediation on behalf of a telecommunications network testing company against allegations of patent infringement in the Northern District of New York.
  • Represented a financial technology company in successfully transferring a patent infringement and trade secret misappropriation suit from the Midland-Odessa Division of the Western District of Texas to the Northern District of California, and challenged the asserted patent on a § 101 motion. The plaintiff dismissed the case with prejudice shortly after the hearing on the § 101 motion.
  • Obtained dismissal of patent infringement litigation brought against a networking technology company in the Western District of Texas based on deficient infringement allegations.
  • Represented patent quality initiative petitioner in a number of inter partes review proceedings at the PTAB seeking to invalidate patents related to financial services processing technology
